1. Scope
These General Terms and Conditions (GTC) apply to all services provided by Bala & Pandhem Gastro Ventures UG (haftungsbeschränkt), operating as "THE BIRYANI CLUB" (hereinafter "we" or "the Restaurant"), located at Otto-Weidt-Platz 14, 10557 Berlin. By using our website, placing an order, or making a reservation, you agree to these terms. These terms apply to both dine-in and delivery/pickup orders.
2. Orders and Reservations
Online Orders When you place an order through our website, you are making a binding offer to purchase the selected items. The order is confirmed once we send you a confirmation or begin preparing your order. We reserve the right to refuse or cancel orders at any time, for example due to item unavailability, pricing errors, or delivery restrictions. Reservations Reservations made through our website or by phone are binding. We kindly ask you to cancel or modify reservations at least 2 hours before the reserved time. Failure to show up without prior cancellation may result in limitations on future reservations.
3. Prices and Payment
All prices displayed on our website include the applicable value-added tax (VAT). Delivery fees, if applicable, are shown separately during the ordering process. We accept the following payment methods: • Cash on delivery/pickup • Card payment (via SumUp) • Online payment through our ordering system Prices may change without prior notice. The price at the time of your order applies.
4. Delivery
We deliver within our defined delivery area in Berlin. The delivery area and any minimum order amounts are displayed during the ordering process. Delivery times are estimates and may vary depending on order volume, weather, and traffic conditions. We strive to deliver your order as promptly as possible. The risk of loss or damage to your order transfers to you upon delivery. Please check your order upon receipt and report any issues immediately.
5. Cancellation and Refunds
Due to the perishable nature of food products, the right of withdrawal under § 312g BGB does not apply to food orders once preparation has begun. If your order has not yet been prepared, you may cancel by contacting us immediately at +49 30 23548602. Refunds for quality issues will be handled on a case-by-case basis. Please contact us within 24 hours of receiving your order if you experience any problems.
6. Allergen Information
We provide allergen information for our dishes upon request. Please inform us of any allergies or dietary requirements when placing your order or making a reservation. While we take all reasonable precautions, we cannot guarantee that our dishes are completely free of allergens due to the shared kitchen environment.
7. Liability
We are liable in accordance with statutory provisions for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty. For other damages, our liability is limited to cases of willful misconduct and gross negligence. Liability for slight negligence is excluded except for the breach of essential contractual obligations (cardinal obligations). Any claims for damages become time-barred within 12 months of the date on which the claimant became aware of the damage, unless they relate to injury to life, body, or health.
8. Intellectual Property
All content on our website, including text, images, logos, graphics, and design, is the intellectual property of Bala & Pandhem Gastro Ventures UG (haftungsbeschränkt) or its licensors and is protected by copyright law. Unauthorized use, reproduction, or distribution is prohibited.
9. Data Protection
Details on how we collect, process, and protect your personal data are provided in our Privacy Policy (Datenschutzerklärung). By using our services, you acknowledge that you have read and understood our Privacy Policy.
10. Applicable Law and Jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from or in connection with these terms is Berlin, Germany, insofar as legally permissible.
11. Severability
If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
12. Changes to These Terms
We reserve the right to modify these terms at any time. Changes will be published on this page with an updated date. Continued use of our services after changes constitutes acceptance of the modified terms.
